Terms of Use

1. Eligibility

You must be at least 13 years old to use the App. If you are under 18, you must have parental or guardian consent. By using the App, you represent that you meet these requirements.

2. Account and Access

No separate registration is required; an account is automatically created based on your device upon first use. You are responsible for maintaining the security of your device and any data associated with your account.

3. Use of the App

• You may use the App to set alarms with AlarmKit, maintain wake-up streaks, complete challenges (math, quiz, text, shake, memory, reaction, photo) to dismiss alarms, listen to relaxing sleep sounds, and track your wake-up achievements.
• The Sleep tab uses Apple HealthKit to display your sleep data. This feature requires your explicit permission and is entirely optional. Granting or denying HealthKit access does not affect alarm or challenge functionality.
• Premium features (Alarmly Pro) may be unlocked through in-app purchases. All purchases are processed through Apple's App Store and are subject to Apple's refund policies.
• Free users have access to basic features with limited alarms and challenge types. Premium subscribers enjoy unlimited alarms, all challenge types, premium sounds, and additional features.

The App is for personal, non-commercial use only. You may not modify, reverse engineer, or distribute the App without our permission.

4. Subscriptions and In-App Purchases

• Alarmly Pro is available as a subscription service with various billing periods (weekly, monthly, yearly). Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage or cancel your subscription through your Apple ID account settings.
• Penalty Dismiss is a one-time consumable in-app purchase that allows you to skip your wake-up challenge for a single alarm event, in exchange for a small fee. Penalty Dismiss purchases are non-refundable and are processed through Apple's App Store. The fee varies by the tier you select in App settings.
• Emergency Snooze is a free feature available to all users, limited to two uses per calendar month. It does not require a purchase and resets automatically at the start of each month.
• Prices for all purchases may vary by region and are subject to change with notice.

5. Apple HealthKit

By enabling the Sleep tab, you grant the App read-only access to your sleep data from Apple Health. You acknowledge and agree that:

• Your HealthKit data will be used solely to display sleep reports within the App and for no other purpose.
• Your HealthKit data will not be used for advertising, marketing, or sold to any third party.
• You can revoke this access at any time via iOS Settings > Privacy & Security > Health > Alarmly without affecting other App features.
• The App does not write any data to Apple Health.

6. Intellectual Property

The App, including its features, designs, sounds, and content, is owned by us or our licensors and protected by copyright, trademark, and other laws. You are granted a limited, non-exclusive license to use the App for its intended purpose.

7. Prohibited Conduct

• Using the App for illegal purposes or in violation of any law.
• Interfering with the App's operation or other users' experience.
• Attempting to access unauthorized data or features.
• Circumventing subscription requirements or payment systems.
• Sharing or distributing App content without permission.

8. Termination

We may suspend or terminate your access to the App at any time for any reason, including violation of these Terms. Upon termination, your right to use the App ends immediately.

9. Disclaimer of Warranties

The App is provided "as is" without warranties of any kind. We do not guarantee alarm reliability in all circumstances, uninterrupted service, or that the App will meet all your requirements. Use at your own risk. Always use backup alarm methods for critical wake-up times.

10. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including but not limited to missed alarms, even if advised of the possibility of such damages.

11. Governing Law

These Terms are governed by the laws of Turkey. Any disputes shall be resolved in the courts of Turkey.

12. Changes to Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the new Terms.
